He regularly appears in the Commercial Court and in commercial arbitrations both in Britain and internationally.
Insurance and reinsurance
Aidan’s experience covers most areas of dispute within the insurance and reinsurance market in the past 25 years.
He was heavily involved in a number of the Lloyd’s Names’ actions and was also instructed in disputes arising out of the terrorist attacks on 9/11 as well as natural disasters in the US including Hurricanes Katrina, Wilma, Rita and Ivan and three of the film finance actions.
His experience in recent years covers the spectrum of insurance and reinsurance business and includes professional indemnity, directors and officers, financial institutions and investment management, property all risks, material damage and business interruption, liability, CAR and EAR, credit, residual value, title indemnity and legal expenses insurance (both BTE and ATE). He regularly advises on policy interpretation and drafting in all of these areas and represents insurers and insureds in disputes arising from such business.
He acts for a wide range of London market and international insurers and reinsurers and has represented them in litigation and arbitration in London and internationally, including Canada and Africa.
Aidan also sits as an arbitrator on insurance and reinsurance disputes and has provided expert evidence on insurance and commercial issues in connection with proceedings in Greece and Russia.
Aidan also has experience in regulatory issues affecting the insurance industry. He has acted on behalf of the Financial Conduct Authority in regulatory proceedings involving the insurance industry.
Aidan has considerable experience of professional negligence cases stemming from his experience in insurance and reinsurance matters (brokers and underwriting agents) as well as across other professions including solicitors, accountants, stockbrokers, valuers, hedge fund directors, financial advisors and agents in the securities industry. He was recently involved in an appeal to the Court of Appeal on a leading case on limitation raising issues of contingent loss. He has been involved in a number of claims arising out of the provision of financial services in Jersey.
Other Commercial Litigation
Aidan is regularly involved in work of a general commercial nature. He is currently representing the operators of the £100 million Connaught Income Fund in a group action involving approximately 1,000 retail investors in a Unregulated Collective Investment Scheme and is also involved in the litigation following the collapse of the Honister/Burns-Anderson IFA networks.
He has provided expert evidence to the Moscow Arbitrazh Court on English law relating to assignments and in 2014/15 to the Russian Courts on English law in respect of guarantees, suretyship and one-way arbitration clauses.
He has appeared in a commercial arbitration before the Japan Commercial Arbitration Association in Tokyo relating to the distribution of Japanese manufactured cars in the UK, has recently represented a major international company in a trial in the Chancery Division relating to a Distribution Agreement in South Africa and has been involved in disputes relating to the pharmaceutical industry in Europe.
